In 1990, the Americans with Disabilities Act introduced the concept of “reasonable acccomodations”
for employees with disabilities.
And nearly 25 years on, employers (and the courts!) still struggle with the implications of that law. Is
pregnancy a disability? Is telecommuting a reasonable accommodation? Is a kangaroo a legitimate
service animal? (True story.)
Then the passing of 2009’s Americans with Disabilities Act Amendments Act (ADAAA) broadly expanded
the scope and impact of the original Act. Today fully 19% of working Americans are classified as living
with a disability under the provisions of the ADAAA. Yet research suggests there is little consistent
understanding of the status quo among employers, let alone what’s coming down the pike.
